Chetty Cup 2025 Tournament – Release, Waiver, and Indemnification Agreement
By signing this Agreement, I, the undersigned, acknowledge and agree to the following terms and conditions as a participant (or parent/legal guardian of a participant) in the Chetty Cup 2025 (the “Tournament”), organized and hosted by California Beach Hockey Club, LLC (CBHC) at Chapman Sports Park in Garden Grove, California.
1. Permission to Participate
I certify that I am either the participant or the parent/legal guardian of the minor participant (collectively referred to as "Participant") who is being permitted to take part in the Chetty Cup 2025 street/ball hockey tournament, including all games, warmups, practices, and related events. I am of legal age and sign this Agreement voluntarily and without inducement. I understand that by signing, I am giving up certain legal rights and remedies on behalf of myself and, if applicable, the Participant.
2. Release of Liability
In consideration of being allowed to participate in the Tournament, I, on behalf of myself, the Participant, and our heirs, assigns, and next of kin (collectively, the “Releasors”), hereby release, discharge, and agree not to sue California Beach Hockey Club, LLC, its directors, officers, employees, volunteers, event staff, agents, officials, sponsors, vendors, and any affiliated entities (collectively, the “Releasees”) from any and all claims, demands, or causes of action arising out of or related to any loss, damage, or injury that may occur as a result of participation in the Tournament, whether caused by the negligence of the Releasees or otherwise. This includes, but is not limited to, claims for personal injury, death, or property damage.
3. Assumption of Risk
I fully understand and acknowledge that participating in street/ball hockey involves inherent risks and hazards, including but not limited to: collisions, slips, falls, contact with other participants, equipment failure, surface irregularities, and exposure to weather conditions. I knowingly and voluntarily assume all risks of participation, including serious bodily injury, permanent disability, and death, whether arising from the acts or omissions of others or otherwise.
4. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, or liabilities, including attorney’s fees, brought as a result of the Participant’s involvement in the Tournament, whether caused by negligence or otherwise.
5. Medical Treatment
I grant permission for emergency medical or dental treatment to be administered to the Participant in the event of injury, accident, or illness occurring during the Tournament. I assume full responsibility for all associated medical costs and authorize the release of medical information necessary for treatment, insurance, or billing purposes.
6. COVID-19 and Infectious Disease Acknowledgment
I acknowledge that participation in public sporting events carries a risk of exposure to COVID-19 and other contagious diseases. I voluntarily assume all risks related to such exposure and agree to comply with any health and safety protocols implemented by the Tournament organizers.
7. Media and Publicity Release
I grant California Beach Hockey Club, LLC the unrestricted right to use my (or the Participant’s) name, likeness, photograph, video, or any other media taken during the Tournament for promotional, commercial, or archival purposes without compensation or further consent.
8. Conduct and Sportsmanship
I agree that the Participant will abide by all Tournament rules, facility policies, and the directions of CBHC staff and officials. CBHC reserves the right to remove any individual for unsportsmanlike conduct, rule violations, or behavior deemed unsafe or disruptive, without refund.
9. Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under or related to this Agreement shall be brought exclusively in the courts of Los Angeles County, California.
11. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, representations, or agreements, whether written or oral, regarding participation in the Tournament.
Electronic Agreement and Signature
By selecting “I Accept” or signing below, I acknowledge that I have carefully read this Agreement, fully understand its terms, and agree to be legally bound by them. I understand that I am waiving substantial legal rights, including the right to sue, and do so freely and voluntarily.
